Telangana High Court Intervenes in Legal Disputes
The Telangana High Court recently made important decisions in three different cases.
First, they stopped the Bar Council from suspending a lawyer named R. Subramanian because the court thought the Bar Council didn't have the right to do that while the lawyer was still being investigated.
The court said the lawyer should be allowed to keep practicing until the investigation is finished.
Second, the court said the state couldn't forcefully take over a function hall in Hyderabad without following the proper legal steps.
The court told the state to unlock the function hall and let the people who rent it use it until the court decides who really owns it.
Lastly, the court stopped the closure of a nursing home in Medak district because the authorities didn't follow the correct procedures.
The court said the nursing home could stay open until they have a proper hearing.
The Telangana High Court suspended the Bar Council of Telangana's decision to suspend lawyer R. Subramanian, finding that the Bar Council lacked the authority to do so pending disciplinary proceedings.
The court restrained state revenue authorities from forcibly dispossessing occupants of MA Garden Function Hall in Hyderabad, stating that such action without due process is impermissible.
Justice E. V. Venugopal stayed the closure of Sri Sai Krishna Nursing Home in Medak district, holding that the mandatory procedure under the Clinical Establishments Act was not followed.
The court emphasized that the Bar Council cannot suspend an advocate's practice merely because disciplinary proceedings are pending.
The panel of Justices Moushumi Bhattacharya and Gadi Praveen Kumar dismissed the state's appeals, upholding the single judge's directions to unlock the function hall and restrain interference.
