SBI ordered to pay ₹1.3 lakh over ₹80,000 ATM fraud
A man who worked in a school saved his money in a bank account.
One day, someone took ₹80,000 from his account without his permission.
The money was taken in four ATM withdrawals on the same day.
The man went to his bank and to the police to complain.
He asked the bank to show the security camera videos to find out what happened.
The bank did not provide the videos or other records.
A special court called the State Commission looked at the case.
The court said the bank did not do its job properly and was at fault.
The bank was told to give the man ₹1.30 lakh plus interest because of the loss.
The court also ordered the bank to pay for the man's stress and court costs.
An SBI customer who works as a government-school lab assistant had ₹80,000 drained from his account via four ATM withdrawals of ₹20,000 each on October 12, 2018.
The account also showed two transfers of ₹40,000 and ₹10,000 to an account belonging to a person named Sonu.
After a failed ATM withdrawal on October 22, 2018, the customer updated his passbook, discovered the fraud, complained to SBI, and lodged an FIR at Mayur Vihar Phase-I police station the same day.
The State Commission, comprising Justice Sangita Dhingra Sehgal and member Bimla Kumari, found that SBI failed to produce CCTV footage, ATM journals, switch records, and authentication details despite being their custodian.
SBI was ordered to pay ₹1.30 lakh with 6% annual interest from the date of the transactions, plus ₹5,000 for mental agony and ₹5,000 in litigation costs.
