Former Supreme Court Judge Warns of Judiciary’s Declining Independence

Justice Deepak Gupta, a former Supreme Court judge, spoke about problems he sees in India’s courts.

He said courts should protect people’s basic rights and allow people to disagree peacefully.

He worried that some courts may be giving too much importance to the views of the majority.

He also said people are sometimes kept in jail for a long time before their trials begin.

Gupta mentioned Umar Khalid and Sonam Wangchuk while discussing liberty and detention.

He questioned how some cases involving religious places and protests have been handled.

He said judges should represent all parts of society and that the process for choosing judges should be more open.

He also criticized lawyers’ organizations for not acting strongly enough against misconduct.

Gupta warned that people may lose faith in courts if the judiciary does not protect justice, equality and freedom.
