Karnataka HC Attaches Aakash Shares in Byju's Dispute
The Karnataka High Court has temporarily frozen some shares of Aakash Educational Services Ltd (AESL) that are linked to Byju Raveendran.
This is part of a legal dispute between Qatar Investment Authority (QIA) and Byju's Investments Pte.
Ltd (BIPL) over a $150 million loan.
The court wants to make sure that the shares aren't moved while they figure out who really owns them.
This freeze doesn't immediately affect AESL's recent rights issue, but it raises questions about who benefits from the shares and whether AESL can show clear records of ownership.
The court will hear more about this in late January.
The Karnataka High Court has attached AESL shares held through Beeaar Investco Pte. Ltd, allegedly beneficially owned by Byju Raveendran, as part of a dispute with Qatar Investment Authority (QIA).
The court's order is a protective measure to prevent the disputed shares from being moved while QIA's request for enforcement of an arbitration award is considered.
The rights issue of ₹100 crore, which concluded in December, is not immediately threatened but raises compliance and governance questions for AESL.
AESL must ensure accurate and complete compliance with the Companies Act, 2013, particularly regarding beneficial ownership disclosures.
The next hearing is scheduled for late January, where the court will consider objections and further evidence.
