Delhi HC: GST Cut Requires Price Reduction, Not Quantity Increase
The Delhi High Court ruled that businesses can't just give consumers more product for the same price after a tax cut; they must lower the price.
When GST rates decrease, companies are required to share those savings with customers by reducing prices.
This applies even if the product is sold for less than its original maximum retail price (MRP).
The court determined that increasing product quantity without reducing the price is deceptive.
Businesses can be penalized, forced to refund customers, or even have their GST registration cancelled if they don't comply.
Delhi High Court ruled on the matter of anti-profiteering.
Court deemed increasing quantity without price cut as deceptive post-GST reduction.
Ruling cited Section 171 of the CGST Act 2017.
The court can order price reductions, refunds, or deposit into a Consumer Welfare Fund.
Court can cancel GST registration for non-compliance.
