India's New SOP Speeds Up M&A Approvals
Imagine companies want to merge or split.
Getting the government's OK used to take a long time.
Now, there's a new, faster process.
Instead of months, it should take about a week to get the first approval.
This is good!
But, it's still not a quick process.
It still requires going to a special court, which takes time.
Also, the new rules are very strict.
Companies only get a few chances to fix any mistakes.
If they miss the deadline, they could be penalized.
While it will speed things up, there's also worry it may still create delays if anything goes wrong.
New standard operating procedure (SOP) sets a 7-day window for processing merger/demerger applications.
The SOP, mandated by SEBI, replaces the previous 3-5 month processing time.
Companies still need NCLT approval, which remains time-consuming.
Concerns exist regarding inflexibility, undefined SEBI timelines, and strict response rules.
The SOP aims to reduce friction, improve timelines, and aid capital deployment.
