High Court overturns rejection of slum dwellers' housing claims
The Punjab and Haryana High Court has decided to cancel a decision made by the Chandigarh Housing Board (CHB).
The CHB had rejected the requests of some slum dwellers who wanted flats under a housing scheme.
The court said this was unfair because the CHB did not give the dwellers a chance to explain their situation or notify them before rejecting their claims.
The dwellers had been recommended for housing by the Estate Officer and the CHB, but their requests were suddenly rejected.
The court's decision means the CHB will have to reconsider these requests fairly.
The Punjab and Haryana High Court set aside the Chandigarh Housing Board's decision to reject housing claims of jhuggi dwellers.
The court found that the CHB's decision was made without issuing any notice or granting a hearing to the dwellers.
The petition was filed by Rajesh Kumar Giri and others, whose cases were recommended by the Estate Officer and the CHB but were later rejected abruptly.
The court held that the rejection violated the principles of natural justice.
The decision affects the Chandigarh Small Flats Scheme 2006.
