Chandigarh Court Acquits Man Due to Procedural Lapses
A man named Vikas Walia from Mohali was declared a proclaimed offender because he didn't show up in court for a case under the Negotiable Instruments Act.
The police registered a case against him under Section 174-A of the Indian Penal Code.
However, the court found that the police didn't follow the correct legal steps to do this.
The court said that the police should have filed a proper complaint, but they didn't.
Also, the court couldn't prove that they had properly given Vikas the court summons and other notices.
Because of these mistakes, the court decided to let Vikas go and acquit him of the charges.
Vikas Walia was acquitted in a proclaimed offender case due to procedural lapses by the prosecution.
The FIR was registered on January 18, 2020, under Section 174-A of the IPC for non-appearance in court.
The court found that the prosecution did not follow the mandatory procedure under Section 195 of the CrPC.
The prosecution failed to prove that summons and other notices were properly served to the accused.
The court relied on previous rulings of the Punjab and Haryana High Court to support its decision.
