Delhi High Court Quashes CRPF Man's Disciplinary Action
The Delhi High Court has decided to cancel the punishment given to a CRPF employee.
The court said that the punishment was unfair because the employee has a mental health condition called Obsessive-Compulsive Personality Disorder (OCPD).
The court explained that mental illness should not be seen as a bad thing or a reason to punish someone.
They said that the laws in India protect people with mental illness and make sure they are not treated badly.
The court also said that the employee should get all the benefits and pay that he missed because of the punishment.
The court gave the authorities 8 weeks to give the employee all the money he is owed.
Delhi High Court quashed disciplinary action against a CRPF man with OCPD, calling it discriminatory and unfair.
The court cited the RPwD Act and Mental Healthcare Act, 2017, emphasizing that mental illness should not be stigmatized.
The petitioner's disciplinary action in March 2020 included a 30% reduction in pension and gratuity.
The court ordered the restoration of the petitioner's increments and consequential benefits within 8 weeks.
