Karnataka High Court Upholds Premium Floor Area Ratio
The Karnataka High Court decided not to stop a rule that allows builders to add extra space to buildings if they pay a fee.
A man who owned land was upset because he thought this rule would make the special rights he got for his land (called TDR) worth less.
He said the rule was unfair and asked the court to stop it.
But the court said the rule is probably okay and didn't stop it.
The court also said that the man chose to take these special rights instead of money, so he can't complain if their value goes down.
The court will talk about this more in February.
Karnataka High Court refused to stay the grant of premium floor area ratio under Section 18b of the KTCP Act.
The petitioner challenged the constitutionality of Section 18b, arguing it would reduce the value of his Transferable Development Rights (TDR).
The court held that the statute must be presumed constitutionally valid unless proven otherwise.
The court did not agree that the change in TDR value affected the petitioner's right to property.
The matter has been listed for further hearing in February.
