Punjab & Haryana HC Dismisses Hooda's Plea, Paves Way for Manesar Land Case Trial
Imagine someone is accused of doing something wrong related to a big land deal.
This person, who used to be a leader, asked a court if their trial could be delayed because some other people involved in the same deal are having their trials paused by a higher court.
However, the court said 'no'.
The judge explained that this person's own request to be cleared of charges was already denied a while ago, and that decision is final for them.
Because of this, their trial can move forward.
The judge also pointed out that this person is accused of more than just one thing, so even if some parts of the case are paused for others, their trial can continue.
The court's decision means the process of officially charging this person can proceed.
The Punjab and Haryana High Court dismissed former Haryana CM Bhupinder Singh Hooda's plea to postpone his trial in the Manesar land corruption case.
The court ruled that Hooda cannot use stays granted to co-accused to halt his own trial.
Hooda's discharge application was rejected by the Panchkula CBI court on September 19, and this order attained finality for him.
The case involves allegations of corruption, cheating, conspiracy, and misuse of official position related to land acquisition in Manesar, with an alleged deal value of over Rs 1,500 crore.
The CBI alleged that farmers were cheated and land use was granted to private builders after acquisition proceedings were dropped.

High Court's Ruling
Trial Postponement
Bhupinder Hooda's Argument
The trial should be postponed because all accused face the same conspiracy charges with common evidence, and the Supreme Court has stayed proceedings for co-accused.
High Court's Ruling
The trial can proceed against Hooda as he did not challenge the 2020 order refusing his discharge. He cannot use the stay granted to co-accused to halt his own case, as he faces other offenses beyond conspiracy.
Finality of Discharge Order
Bhupinder Hooda's Argument
Hooda implicitly sought to delay the framing of charges by arguing against proceeding while co-accused have stays.
High Court's Ruling
The 2020 order denying Hooda's discharge application has attained finality for him, leaving the trial court with no option but to frame charges against him.
