Madras High Court Quashes FIR, Orders Compensation
The Madras High Court decided to cancel a criminal case (FIR) against a man and ordered the government to pay him Rs 8 lakh.
The court said the case was unfairly filed against him in 2017 and had been pending for eight years without proper investigation.
The man could not find a job because of this case, and the court said this was a violation of his rights.
The court also said that being accused of a crime can harm a person's reputation and mental health, even if they are innocent.
The court found that the police did not follow proper procedures and that there was not enough evidence to support the case.
Madras High Court quashed an FIR against a man accused of preparation for dacoity under Section 399 IPC.
The court ordered Rs 8 lakh compensation for mental suffering, social stigma, and loss of job opportunity.
The FIR was filed in 2017 but was only sent to the trial court in 2025, violating Section 157 CrPC.
The court found no evidence to support the allegations and deemed the case as foisted.
The petitioner's counsel argued that the case was filed without proper evidence and violated the petitioner's rights under Article 21 of the Constitution.
