Gifting Property Between Spouses: Tax Rules Explained
In India, a wife can gift her flat to her husband without paying taxes immediately.
However, there's a 'clubbing provision'.
This means any money earned from that property, like rent, gets added to the wife's income for tax purposes.
This rule applies even if the property is sold and the money is used for something else.
While there is no gift tax between spouses, you still need to pay fees to register the transfer, and some areas offer lower rates for these gifts.
The husband can later sell the property, but taxes on any profit are still linked to the wife's income.
Gifts between spouses in India are not considered taxable income.
Gifts from unrelated persons become taxable if they exceed Rs 50,000 in a year.
Income generated from gifted property is taxed with the gift-giver's income.
The original purchase cost and holding period of the wife are considered for tax calculation.
Stamp duty and registration charges apply to spousal property gifts.
