Kerala High Court Dismisses Transgender NCC Enrollment Plea
A court in Kerala looked at a case where a person who is transgender wanted to join a youth group called the National Cadet Corps (NCC).
The court said that right now, the rules only allow boys and girls to join, not people who are transgender.
This is because the training involves activities where knowing someone's gender is important for their safety and comfort.
The judge felt that it would be good for transgender students to have the same chance to join, but changing the rules would need the government to think about it carefully and maybe create new laws.
The court sent the decision to the government to consider making new rules.
The Kerala High Court dismissed a plea from a 22-year-old transgender candidate seeking enrollment in the National Cadet Corps (NCC).
The court stated that the National Cadet Corps Act, 1948, does not currently include provisions for transgender individuals.
The ruling cited that NCC training, involving close contact and camps, considers gender important for cadet well-being and safety.
The court acknowledged that transgender students ideally should have equal opportunities for NCC training.
The High Court forwarded its judgment to the Ministry of Defence and Ministry of Law and Justice to consider policy changes and potential legislative intervention.
