Madras High Court Allows Puducherry Reservation Through Native Mothers

Madras High Court Allows Puducherry Reservation Through Native Mothers

The Madras High Court considered cases involving children whose mothers were from Puducherry.

Their fathers had mostly moved there from nearby districts in Tamil Nadu.

Both parents belonged to the same community.

The children were born and raised in Puducherry and studied there.

The government had argued that caste should normally be linked only to the father.

The court said this approach could unfairly treat mothers and fathers differently.

It decided that the important question is whether the child experienced the disadvantages linked to the community.

Eligible children can therefore receive reservation benefits through their mother’s Puducherry origin, if their claims are genuine.
