Onkar Infotech Wins Pushpanjali Farms Dispute Against GMR
Imagine a company called Onkar buying a fancy house in Delhi.
Another company, GMR, was renting it but didn't have a proper, registered lease.
The court said that since the lease wasn't registered, it wasn't valid.
This means GMR had to move out.
Onkar had followed all the rules when they bought the house.
The court's decision was based on rules about leases: if it's longer than a year, it MUST be registered.
The court pointed out that GMR was using the house as a luxury residence with a pool, not for farming, so it wasn't protected by farmland laws.
Delhi High Court ruled in favor of Onkar Infotech regarding Pushpanjali Farms.
The court found GMR's unregistered lease unenforceable.
Onkar Infotech purchased the property for ₹115 crore in May 2024.
DIAL and affiliates were paying rent of approximately ₹45.62 lakh + GST.
The court cited Sections 17 and 49 of the Registration Act, 1908.
