Bombay High Court Validates BJP Candidate's Nomination
The Bombay High Court decided that the nomination form of a BJP candidate, Nilesh Chhaburao Bhojane, for a local election in Navi Mumbai was valid.
The court said the decision to reject his form was illegal.
The court also said the election for Ward 17-A should go ahead as planned, and Bhojane's name should be added to the list of candidates.
The rejection was based on a complaint about unauthorized construction, but the court ruled that this rule does not apply to candidates who are not yet councillors.
The court looked at past decisions and said the rejection was wrong.
The election will now include Bhojane's name, and voters will not have to come back to vote again.
Bombay High Court validated BJP candidate Nilesh Chhaburao Bhojane's nomination for Ward 17-A of the NMMC.
The court quashed the returning officer's decision to reject Bhojane's nomination, calling it 'patently illegal'.
The court directed the inclusion of Bhojane's name in the list of valid candidates and vacated the stay on the election.
The rejection was based on a complaint by Shiv Sena leader Kishor Patkar about unauthorized construction by Bhojane.
The court ruled that Section 10(1D) of the Maharashtra Municipal Corporations Act, 1949, does not apply to candidates filing nomination papers.
