High Court Upholds Acquittal in NDPS Case
The High Court in Chandigarh decided to keep the decision of a lower court that said a man named Anil Tanwar was not guilty in a case about drugs.
The police had said they found some heroin on him in 2018, but the courts said the police did not follow the rules properly.
The High Court agreed that the police made many mistakes, like not writing reports correctly and not telling their bosses about the case.
Because of these mistakes, the courts said they could not be sure Anil Tanwar was guilty, so he was let go.
The High Court also said the police's case was not strong enough to change the lower court's decision.
The Punjab and Haryana High Court upheld the acquittal of Anil Tanwar in a 2018 heroin recovery case.
The court criticized the Chandigarh Police for serious lapses in the investigation, including failure to comply with NDPS Act procedures.
Key issues included inconsistencies in witness statements and contradictions in case documents.
The police failed to send special reports to superior officers, which the court said affected the credibility of the case.
The High Court dismissed the Chandigarh administration's appeal, stating that the trial court had correctly assessed the flaws in the investigation.
