Bombay HC rules housing loan interest cannot reduce motor accident compensation
The Bombay High Court made a decision that helps families of people who died in car accidents.
The court said that when calculating how much money the family should get, you shouldn't take away the money spent on a house loan.
The insurance company wanted to take away this money, but the court said no.
The court said that the money for the family should be based on what the person earned, not what they paid in taxes.
This way, the family gets more money to help them after losing their loved one.
The court also said that the money from the accident should start being paid from the day the family asks for it, not from a later date.
The Bombay High Court ruled that housing loan interest cannot be used to reduce the income of a deceased person while calculating motor accident compensation.
The court enhanced the compensation by ₹17.58 lakh for the family of a deceased medical practitioner.
The court held that income-tax provisions cannot be imported to lower compensation payable to accident victims' families.
The insurance company argued that only the deceased's disposable income, after deducting housing loan interest, should be considered.
The court clarified that interest on compensation should run from the date the claim petition is filed under the Motor Vehicles Act.
