Uttarakhand High Court Unfreezes Bank Account Frozen for 6 Years
A man's bank account was frozen for 6 years because of a corruption investigation.
He was not accused of any crime, but his account was frozen because money from a land scam was deposited there.
He asked the court to unfreeze his account, but the lower court said no.
So, he went to the high court.
The high court said that freezing someone's bank account for years without trial or conviction is not right.
They unfroze his account but said he has to give security equal to the amount in question.
This means the money can't be used, but he can access his account again.
The Uttarakhand High Court ordered the unfreezing of a man's bank account that was frozen for 6 years due to a corruption probe.
The man was not named as an accused in the FIR or chargesheeted.
The court ruled that the mere pendency of a criminal trial does not justify the indefinite freezing of property of someone not facing trial.
Freezing a bank account amounts to seizure of property and is a serious intrusion into proprietary and economic rights.
The court directed the bank account to be unfrozen subject to the account holder furnishing adequate security equivalent to the amount alleged to be connected with the offence.
