Thane Court Upholds Order Quashing ₹73.7 Lakh MIDC Water Bills
A court in Thane, India, recently made a decision about a long-running argument between a textile company and a government organization called MIDC.
The MIDC had sent a big water bill of ₹73.7 lakh to the company, saying they used too much water because their water meter was tampered with.
The court decided that the MIDC did not follow the correct rules when sending this bill.
They did not test the meter properly or give the company a chance to explain before sending the bill.
The court said the company does not have to pay this bill and the MIDC cannot cut off their water supply.
The court also said that the company had the right to go to court without first paying the disputed amount.
Thane Sessions Court dismissed MIDC's appeal, upholding a trial court order that quashed ₹73.7 lakh water bills issued to M/s Oceana Textile Mills Pvt Ltd.
The court found that MIDC failed to follow mandatory procedures under the Water Supply Regulations, 1973, including testing the meter and issuing a show-cause notice.
MIDC issued revised bills alleging excessive water consumption due to a supposedly tampered water meter, but no proof of tampering was provided.
The court noted that MIDC officials who allegedly detected the tampering were not examined as witnesses, and no personal knowledge of the inspection was admitted.
The court upheld the company's right to seek legal remedy without first paying the disputed amount under protest.
