Delhi HC: Widows Entitled to Maintenance from Father-in-Law's Estate
The Delhi High Court made a decision about widows and money.
If a woman's husband dies, and then her father-in-law dies, she can ask for financial help from his property.
However, this only applies to property that is ancestral or jointly owned by family members.
The court said that the law intends to provide for widows.
If the father-in-law only has his own personal property, she may not be able to get support from it.
Delhi High Court ruled widows can claim maintenance from their deceased father-in-law's estate.
Maintenance is limited to the father-in-law's coparcenary (ancestral) property.
The ruling stems from Section 19(1) and 21(vii) of the Hindu Adoption and Maintenance Act (HAMA).
The court stated the father-in-law's duty arises from ancestral property.
The case involved a widow whose husband died in March 2023 and father-in-law in December 2021.
