Foreign Citizenship Does Not End Inherited Agricultural Land Rights

Foreign Citizenship Does Not End Inherited Agricultural Land Rights

A person may still inherit agricultural land in India after becoming a foreign citizen.

Inheritance can happen through family succession or a valid will.

The land must have been legally acquired by the previous owner.

However, owning inherited land and selling it are different things.

An NRI is an Indian citizen living outside India.

Someone who gives up Indian citizenship is not an NRI under FEMA.

That person may instead be an OCI or another type of foreign national.

Under the general rules, inherited agricultural land can be transferred only to an eligible Indian resident.

Banks and investment accounts may also need updated KYC information after a citizenship or residency change.
