SC restores dismissal of CISF personnel for second marriage
The Supreme Court of India decided to keep the punishment of a man who was fired from his job in the Central Industrial Security Force (CISF).
He was fired because he got married a second time while he was still legally married to his first wife.
The rules of the CISF say that if someone is married and then marries again, they can be dismissed from service.
The man's first wife told the authorities about the second marriage, and after an investigation, he was fired.
The man went to the high court, which said maybe he should not be fired but just removed from service.
But the Supreme Court said no, the original punishment should stay because the rules are clear and important for maintaining discipline in the force.
So, the man will not get his job back.
The Supreme Court restored the dismissal of a CISF constable who married a second time while still legally married to his first wife.
The man was dismissed from service on July 1, 2017, following disciplinary proceedings initiated by his first wife's complaint.
The Gauhati High Court had suggested a lesser penalty, but the Supreme Court upheld the original dismissal.
The Supreme Court emphasized that the rules are not arbitrary and are necessary to maintain discipline and integrity in the force.
The court noted that the high court's powers are limited to judicial review and cannot substitute its judgment for that of the disciplinary authority unless there is substantial non-compliance with the rules.
