Supreme Court Declines to Quash FIR Against Abdullah Azam Khan in Forgery Case
Imagine someone is accused of using a fake paper to get a passport.
This person was already in trouble for making that fake paper in the first place.
He asked the highest court to say he shouldn't be in trouble again for using the fake paper because he already got in trouble for making it.
This is like saying you can't be punished twice for the same mistake.
But the court said that making the fake paper and using it to get a passport are two different mistakes.
So, they said the person still has to go to trial to figure out if he's guilty of using the fake paper for the passport.
The court didn't want to stop the trial from happening.
The Supreme Court dismissed a plea by former UP MLA Abdullah Azam Khan to quash an FIR concerning the use of forged documents for a passport.
The court upheld the Allahabad High Court's order, which had previously refused to quash the FIR.
Abdullah Azam Khan argued the case amounted to double jeopardy as he was already convicted for procuring the forged birth certificate used for the passport.
The Allahabad High Court ruled that obtaining the forged birth certificate and using it for a passport were distinct offenses, thus double jeopardy did not apply.
The Supreme Court allowed the trial court to proceed with the case without being influenced by prior orders.
