Indore High Court Quashes 12-Month NDPS Detention Order
The Indore High Court in Madhya Pradesh has canceled a 12-month detention order against a man named Jamnalal Dhakad.
The court said the government did not follow the proper rules when they detained him.
The government had accused Dhakad of being involved in drug-related crimes and wanted to keep him in detention to prevent more crimes.
However, Dhakad said he was innocent and that the government did not give him a fair chance to defend himself.
The court agreed with Dhakad and said the government did not provide the necessary documents to support the detention.
Therefore, the court ordered Dhakad to be released immediately.
The Indore bench of the Madhya Pradesh High Court quashed a 12-month preventive detention order against Jamnalal Dhakad under the PITNDPS Act.
The detention was based on police recommendations alleging Dhakad's involvement in five NDPS cases and other criminal offences.
The State argued that Dhakad was a habitual offender involved in commercial quantities of poppy straw and that preventive detention was necessary.
Dhakad contended that he had been falsely implicated and that his representations were not considered.
The High Court found that the State had not placed the Advisory Board's opinion on record, which is a mandatory safeguard for prolonged preventive detention.
