Supreme Court: Broadcasting Services Taxable by Centre, State
Imagine TV companies that broadcast to your home.
The Supreme Court has decided the government can collect two different taxes.
One tax is like a fee for sending the TV signal, and that goes to the federal government.
The other tax is for the entertainment you watch, like your favorite shows, and that goes to the state government.
The court explained this is okay because the government and the states are taxing different parts of the same business.
The Supreme Court ruled broadcasting can be taxed by both Centre and State.
Centre can impose service tax; the State can levy entertainment tax.
The court stated there's no overlapping in the taxes.
Broadcasting is a service liable for service tax.
Entertainment falls under the State's jurisdiction for taxation.
