Mumbai Orders Niva Bupa to Pay ₹66.5 Lakh for Denied Cancer Claim
A man named Alok Rajendra Bector bought a health insurance policy from Niva Bupa that covered treatments worldwide.
He was treated for cancer in the United States and asked the insurance company to pay for it.
But Niva Bupa refused to pay, saying he had not told them about his asthma when he first bought the policy.
The man said his asthma had nothing to do with his cancer.
The court agreed with him and said the insurance company was wrong to refuse payment.
The court ordered Niva Bupa to pay ₹66.5 lakh for the treatment, plus extra money for compensation and legal costs.
The insurance company has 60 days to pay, or they will have to pay extra interest.
The Mumbai Consumer Commission ordered Niva Bupa to pay ₹66.5 lakh for wrongfully denying a cancer treatment claim.
Alok Rajendra Bector, a Juhu resident, had purchased a 'Heartbeat – Family First Platinum Policy' with worldwide coverage.
Niva Bupa denied the claim citing an alleged nondisclosure of asthma, which the court found unrelated to the cancer diagnosis.
The commission found Niva Bupa guilty of deficiency in service and unfair trade practice.
Niva Bupa must pay ₹30,000 as compensation and ₹10,000 towards litigation costs within 60 days, or face a 6% annual interest rate.
