NCLT Dismisses RCom's Refund Plea to Ericsson
Reliance Communications (RCom) asked a court to give them back ₹325 crore they paid to a company called Ericsson.
The court said no because the money was paid to follow orders from a higher court, not because of bankruptcy rules.
RCom had to pay Ericsson ₹550 crore to avoid trouble with the Supreme Court.
The court said the payment didn't hurt RCom's bankruptcy process because the money didn't come from RCom's assets.
Ericsson said the request for a refund was wrong because the payment was ordered by the Supreme Court.
NCLT dismissed RCom's plea for a ₹325 crore refund from Ericsson.
The payment was made to comply with a 2019 Supreme Court contempt order.
NCLT ruled the payment did not violate insolvency norms.
The funds paid to Ericsson came from other Reliance group entities, not insolvent companies' assets.
Ericsson argued the refund claim was misconceived and should have been challenged in the Supreme Court.
