Punjab & Haryana High Court Upholds 1988 Land Sale After 37-Year Dispute
Imagine a family had some land, and some brothers sold a part of it a long, long time ago to buy materials for a shop.
Their children, many years later, said their dads shouldn't have sold it because it was special family land.
But a judge looked at the papers and said the land wasn't 'special family land' in the way they thought.
The judge also said it was okay for the dads to sell it because they used the money to start a business, which is a good reason.
Finally, the judge mentioned that the kids waited too long to complain, and there's a rule about how long you can wait to challenge a sale.
So, the judge said the sale was okay, and the person who bought the land can keep it.
The Punjab & Haryana High Court upheld a 1988 sale of agricultural land, ending a 37-year legal dispute.
The court determined the land was not ancestral coparcenary property, as it did not descend through at least four male generations undivided.
The sale proceeds were used to establish a business, which the court recognized as a genuine legal necessity.
The court also ruled the suit filed by the sons was barred by the Limitation Act, as it was filed more than three years after the sale.
Justice Deepak Gupta dismissed the appeal, stating no substantial question of law arose for further consideration.
