CJI Flags Judicial Trend of Pre-Retirement Orders
The Chief Justice of India, Surya Kant, recently spoke about a concerning trend where some judges make a lot of decisions right before they retire.
He mentioned this while hearing a case about a district judge from Madhya Pradesh who was suspended just 10 days before his retirement.
The judge had passed two orders that led to his suspension.
The Supreme Court also noted that the judge's retirement age was increased to 62, so he would now retire a year later.
The court advised the judge to approach the high court instead of the Supreme Court for his suspension case.
They also said it's not appropriate for a senior judge to use RTI to get information about their suspension.
CJI Surya Kant highlighted a trend of judges passing orders for extraneous considerations before retirement.
A district judge from Madhya Pradesh was suspended 10 days before his retirement over two judicial orders.
The Supreme Court directed the Madhya Pradesh government to postpone the judge's retirement by one year due to an increased retirement age.
The court questioned why the judge did not approach the high court to challenge his suspension.
The Supreme Court declined to entertain the plea and advised the judge to approach the high court instead.
