Supreme Court Exempts Telangana Irrigation Projects from 2021 Memorandum
The Supreme Court of India decided that some big water projects in Telangana, like the Palamuru and Seethamma Sagar schemes, can keep going even though a new rule from 2021 might have stopped them.
The court said the 2021 rule was not legal because it changed how the law about environmental checks works.
It also said that any new project must get all the environmental approvals before it starts.
This means the projects can finish without having to redo their approvals.
The court made it clear that getting environmental clearance is a must, not just a formality.
Supreme Court exempted Telangana irrigation projects from the 2021 Office Memorandum ruling that quashed a central environmental clearance mechanism.
Court ruled the 2021 Office Memorandum was legally unsustainable, as it altered the statutory environmental clearance framework under the Environment (Protection) Act 1986 and EIA Notification 2006.
Environmental clearances issued under the 2017 Notification and the 2021 Memorandum remain valid unless challenged.
Court emphasized environmental compliance is a mandatory statutory requirement, not a procedural formality.
Future projects must obtain all required environmental clearances before starting work.
