Bombay HC Voids Illegal Report, Quashes Recovery Order
The Bombay High Court said a report about money problems in a housing society was not valid because the person who wrote it was no longer allowed to do so.
The court also said the society didn't have to pay back ₹49.45 lakh because of this.
The court decided that a new person should look into the problem and make a new report.
This is because the old report was made by someone who didn't have the right to do it anymore.
The court also said that some people were unfairly blamed for the money problems and that needs to be fixed.
Bombay High Court voided a Section 88 report filed by a replaced officer.
The court quashed a ₹49.45 lakh recovery order based on the invalid report.
Justice Amit Borkar ruled that the officer lost authority after being replaced.
The court directed a fresh Section 88 inquiry by an authorized officer.
Eight members challenged the report, citing lack of examination of key documents.
