SC sets aside Himachal HC order on orchard removal
The Supreme Court of India has canceled a decision made by the Himachal Pradesh High Court.
The High Court had ordered the removal of apple orchards from forest land, which would have affected many farmers and landless people.
The Supreme Court said this was a mistake because it would have very serious consequences, like cutting down fruit-bearing trees and causing environmental problems.
The Supreme Court asked the state government to make a plan to help these people instead.
They also said the state can still take action against people who have taken over forest land illegally.
This decision is good news for the apple growers in Himachal Pradesh who were worried about losing their trees and their livelihood.
The Supreme Court set aside the Himachal High Court order directing the removal of orchards from encroached forest land.
The High Court's order was deemed to have drastic consequences affecting marginalized and landless people.
The Supreme Court asked the state government to formulate a proposal for the Centre to help the affected people.
The state government can still take action against encroachment on forest land.
The High Court's order was criticized for not conducting a comprehensive environmental impact assessment and for threatening livelihoods.
