SC sets aside Rajasthan HC order on rape accused's wife
The Supreme Court has canceled a decision made by the Rajasthan High Court.
The Rajasthan High Court had said that the wife of a man accused of rape had to stay in India if he wanted to go abroad for work.
The Supreme Court said this was not fair because the wife is not involved in the case and is working in the United States.
The man promised to attend all court hearings through video calls and to come to court in person when asked.
The Supreme Court also made him deposit Rs 2 lakh as a guarantee.
The case is about a man who allegedly promised to marry a woman but did not, and is accused of rape.
The Supreme Court set aside a Rajasthan High Court order requiring the wife of a rape accused to remain in India.
The accused is a software engineer who wants to travel abroad for a job.
The Supreme Court accepted the accused's undertaking to attend hearings via video-conferencing and be physically present when directed.
The Rajasthan High Court's order was criticized for violating procedural norms and fundamental rights.
The accused was allowed to travel abroad after depositing Rs 2 lakh as surety.
