Corporate Fraud Enforcement Lags in India
In India, there have been big cases of corporate fraud, like the one involving Mehul Choksi and the Reliance ADAG group.
These frauds are hard to investigate and recover money from because the criminals use complicated methods to hide their tracks.
The government set up a special agency called the Serious Fraud Investigation Office (SFIO) to handle these cases, but it has not been very effective.
The law says that once SFIO starts investigating a case, other agencies should help them and not investigate the same case.
A court in Delhi also supported this idea.
The author thinks that SFIO should be given more power and clarity to work better and faster, so that fraudsters can be caught and punished quickly, and the money can be recovered faster.
Recent corporate fraud cases in India, including Mehul Choksi's extradition and allegations against Reliance ADAG, highlight the complexity and scale of financial crimes.
Investigations into corporate frauds are often slow and ineffective, with only a fraction of the money being traced and recovered.
The Serious Fraud Investigation Office (SFIO) was established to tackle complex corporate frauds but has faced challenges due to lack of legislative backing and jurisdictional overlaps.
The Companies Act, 2013 mandates that all investigations related to corporate fraud should be transferred to the SFIO, and other agencies should provide all relevant information.
The Delhi High Court supported the SFIO's authority to investigate offenses under other statutes if they are part of the same transaction, emphasizing the need for a single, coordinated investigative mechanism.
