Gujarat HC Upholds Tribunal Route for Contractor Disputes
Imagine contractors who build roads and buildings for the city sometimes disagree with the city about money.
Usually, they could hire a private judge (arbitrator) to solve the problem.
But, the Gujarat High Court made a decision.
It said these disagreements now have to go to a special government tribunal instead of private judges.
This new rule applies to contractors working with the Ahmedabad city government.
The court decided this because using private judges takes too long.
The court hopes the new tribunal will be faster, so everyone can get their issues resolved more quickly.
Gujarat High Court upheld a notification requiring contractors' disputes with Ahmedabad Municipal Corporation (AMC) to go through a tribunal.
The ruling prevents contractors from using private arbitration for payment disputes.
The order was made on September 19th and applies to disputes under the Arbitration and Conciliation Act, 1996.
The government argued that the 1992 Gujarat Public Works Contract Disputes Arbitration Tribunal Act covers such works.
The court cited delays in private arbitration and dismissed contractor petitions.
