Telangana High Court Upholds Consumer Court Jurisdiction in Chit Fund Dispute
The Telangana High Court recently made an important decision about chit fund disputes.
A woman named C Yoga Lakshmi had won a chit worth Rs 10 lakh, but the chit fund company, M/s Sreenilaya Chit Fund Pvt Ltd, didn't pay her the money.
She went to a consumer court, which ordered the company to pay her Rs 8,90,000 plus interest and compensation.
The company then challenged this in the High Court, saying only a specific government official should handle such cases.
But the High Court disagreed and said consumer courts can indeed handle chit fund disputes.
The court also criticized the company for delaying payments and not treating subscribers fairly.
In the end, the High Court upheld the consumer court's decision, and the company was told to pay the woman as ordered.
The Telangana High Court ruled that consumer forums have jurisdiction over chit fund disputes, rejecting the chit fund company's argument that only the Registrar of Chits has this authority.
The dispute involved M/s Sreenilaya Chit Fund Pvt Ltd and subscriber C Yoga Lakshmi, who won a chit worth Rs 10 lakh but was not paid the bid amount.
The District Consumer Disputes Redressal Commission ordered the company to pay Rs 8,90,000 with 12% interest, plus Rs 50,000 for mental agony and Rs 5,000 in costs.
The High Court emphasized that the Consumer Protection Act is intended to address consumer grievances and overrides older statutes like the Chit Fund Act, 1982.
The court criticized the chit fund company for delaying payments and failing to fulfill its obligations to subscribers, who are often from middle-income groups with important financial needs.
