Telangana High Court Orders Passport Renewal for NRI
The Telangana High Court recently ordered the Central government to renew the passport of an Indian citizen living in the USA.
This person is accused in a dowry case but the court said that just because there is a case against him, it doesn't mean he can't renew his passport.
The court explained that the right to travel is important and can't be taken away without a good reason.
The man has been living in the USA for over 10 years and his passport was about to expire.
He said the charges against him are baseless.
The government argued that he didn't tell them about the case when he applied for renewal.
The court decided that he should get his passport renewed.
Telangana High Court directed the Central government to renew an NRI's passport, who is accused in a dowry case.
Justice Nagesh Bheemapaka ruled that pendency of criminal proceedings without a judicial order cannot deny passport renewal.
The petitioner, residing in the USA for over a decade, applied for passport renewal before its expiry on November 30.
The government argued that the petitioner misrepresented facts by not disclosing his accused status in the passport renewal application.
The court emphasized that the right to hold and renew a passport is an extension of the right to travel under Article 21.
