Karnataka High Court Overturns KRERA Fee for Late Filings
Imagine a rule that made people pay extra if they turned in their homework late.
The Karnataka Real Estate Regulatory Authority (KRERA) had a similar rule for real estate developers, making them pay extra if they were late submitting reports.
But the High Court said this rule wasn't fair.
The court decided that KRERA didn't have the power to charge these late fees because the law about real estate didn't say they could.
The court explained that you can't just make up a fee; it has to be written in a law.
So, the High Court canceled the rule, meaning developers don't have to pay those extra fees anymore.
Karnataka High Court overturned a KRERA circular.
The circular imposed fees for late submissions of quarterly updates and audit statements.
Justice M Nagaprasanna delivered the ruling.
The court found the fee imposition was outside the scope of the Real Estate (Regulation and Development) Act 2016.
The court stated no fees can be levied without statutory authority.
