SAT overturns Sebi's order against Bombay Dyeing
The Securities Appellate Tribunal (SAT) has overturned a decision made by the market regulator, Sebi, which had accused Bombay Dyeing and the Wadia family of falsely reporting their financial records.
SAT found that the agreements between Bombay Dyeing and another company, SCAL, were real and not fake, as Sebi had claimed.
The tribunal also noted that there was no unusual activity in Bombay Dyeing's share price and that the promoters did not benefit from selling shares at higher prices.
As a result, the penalties imposed by Sebi have been canceled, and any money already paid must be returned within four weeks.
One judge disagreed with this decision, but the majority ruled in favor of Bombay Dyeing and the Wadia family.
SAT overturned Sebi's 2022 order against Bombay Dyeing and the Wadia family, finding no evidence of fraudulent financial misrepresentation.
The tribunal directed the refund of any penalties paid within four weeks.
Sebi had alleged that Bombay Dyeing inflated sales and profits through transactions with SCAL Services Ltd.
SAT found that the MOUs between Bombay Dyeing and SCAL were genuine, as SCAL sold some flats to final buyers.
The decision was not unanimous, with one presiding officer dissenting and agreeing with Sebi's allegations.
