SC to Examine Plea Against Lifetime Immunity for Poll Officers
The Supreme Court is looking at a big question: should the people who run elections in India, called Election Commissioners, be protected from being taken to court for their work, even after they retire?
A group called Lok Prahari thinks this is not fair because even the President of India doesn't get such protection.
They say this law might make elections less fair.
The court said they will think about it and asked the government and the Election Commission to explain their side.
They didn't stop the law from working right now.
The court also said that no court can take any action against these officers for anything they do while working, which the group says is too much power.
Supreme Court agreed to examine a plea challenging lifetime immunity for Election Commissioners under the CEC Act, 2023.
The plea was filed by NGO Lok Prahari challenging Section 16 of the CEC Act, 2023.
The provision grants lifetime immunity to CEC and ECs from civil and criminal proceedings for actions taken during their official duties.
The bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi issued notices to the Centre and the Election Commission but refused to stay the provision.
The petitioner argued that the provision gives unprecedented and unbridled power to the CEC and ECs, providing them complete blanket permanent immunity for life.
