Income Tax Act 2025: Digital Search Rules Clarified
The Income Tax Department in India is getting new rules to help them find people who are not paying their taxes correctly.
These rules, under Section 247 of the new Income Tax Act, 2025, will allow them to look at digital things like emails, social media, and online bank accounts.
But they can only do this if they have a good reason to think someone is hiding money or not following the tax rules.
They also have to follow certain steps to make sure they are not breaking anyone's privacy rights.
So, it's not about spying on everyone, but about making sure people pay their taxes fairly.
The Press Information Bureau (PIB) has clarified that these measures are specifically designed to target black money and large-scale evasion during search and survey operations, not the everyday law-abiding citizen.
Section 247 of the Income Tax Act, 2025 allows tax officers to search and seize digital data during tax investigations.
The new rules will come into effect on April 1, 2026, replacing the 1961 Act.
Access to digital accounts is permitted only when there is a legal summons, notice, and reasonable suspicion of tax evasion.
Procedural protections include authorization orders, explanations, inventories, and judicial review to safeguard taxpayer rights.
