Chhattisgarh HC Upholds Conviction for Outraging Modesty

The Chhattisgarh High Court has upheld a lower court's decision to convict a young man for outraging a woman's modesty.

The incident happened in 2019 when the man held the victim's hand, pulled her towards him, and said 'I love you' as she was returning home from school.

The court found that this behavior was highly objectionable and fell under Section 354 of the Indian Penal Code, which deals with assault or criminal force to outrage a woman's modesty.

The man was initially convicted under both Section 354 and the POCSO Act, but the High Court dropped the POCSO charge due to lack of evidence regarding his minor status at the time of the crime.

He was sentenced to three years of imprisonment under Section 354.
