Kerala High Court Rules Muslim Women Can Seek Maintenance Beyond Personal Law
The Kerala High Court recently made an important decision about Muslim women and maintenance after divorce.
The court said that a divorced Muslim woman can ask for more money from her husband, even if he has already given her the amount required by Muslim personal law.
The court looked at a case where a woman was divorced when she was 17 years old and only received Rs 1 lakh, which the court thought was not enough for her future.
The court said that the husband needs to make sure the woman has enough money to live on and that the family court should look at the case again to decide if the woman needs more money.
The court also said that the husband has to prove that the woman can support herself if he doesn't want to pay more.
Kerala High Court ruled that a divorced Muslim woman can claim maintenance beyond the limits set by personal law.
The court cited a verse from the Quran to support its decision, emphasizing the husband's obligation to provide for his divorced wife.
The family court had denied maintenance to a 17-year-old divorced woman, stating she had already received the required amounts under the Muslim Women (Protection of Rights on Divorce) Act, 1986.
The High Court found the one-time payment of Rs 1 lakh inadequate for the woman's future livelihood and remanded the case for fresh consideration.
The court clarified that the rights under secular maintenance law and personal law co-exist and must be harmoniously construed.
