Bombay HC Orders BMC to Reassess Goregaon Flyover Compensation
The Bombay High Court has told the BMC that they need to follow a specific law from 2013 to pay fair compensation to people whose buildings were affected by the Goregaon flyover project.
The court said the BMC made a mistake by using the wrong rules to decide how much money to give.
They also said the BMC should not have demolished buildings without paying first.
The court wants the BMC to start the process of deciding compensation again and finish it within a year.
They also said that any arguments between the building owners and the people who rent the buildings about how to split the compensation can be sorted out later.
The Bombay High Court ruled that the BMC must follow the 2013 land acquisition law to compensate buildings affected by the Goregaon flyover project.
The court quashed a 2018 compensation order by the Deputy Municipal Commissioner, which had fixed compensation at Rs 2,17,97,650 for the lessee-petitioners.
The BMC was directed to initiate fresh acquisition proceedings under the 2013 law and complete the process within one year.
The court found that the BMC had applied the wrong legal provisions and violated the principles of natural justice by not hearing the landowners before fixing the compensation amount.
Disputes between landowners and lessees regarding their respective shares in the compensation can be decided separately after the fresh compensation award is passed.
