Supreme Court: Adultery Plea Must Precede Interim Maintenance
The Supreme Court of India said that if a husband says his wife is cheating, the court has to decide that first before giving the wife any money.
The court looked at a case where the husband gave pictures and other proof.
They said the court should check that proof right away.
They also said that people who secretly take pictures need rules to keep everyone safe.
The court told the government to think about new rules for private investigators.
Supreme Court ruled that a husband's adultery claim must be decided before granting interim maintenance to the wife.
The decision applies when the husband can establish adultery ex facie with evidence.
The ruling was based on a case where the husband filed under Section 125(4) CrPC.
The court emphasized that evidence must be examined at the interim stage and that private investigators' methods need regulation.
The judgment directs the government and law commission to review and possibly regulate private investigation practices.
