Supreme Court Reviews Transgender Athlete Bans
The US Supreme Court is looking at laws in Idaho and West Virginia that stop transgender athletes from playing in girls’ and women’s sports.
These laws say that transgender women, who were born male, have physical advantages that make it unfair for them to compete with biological women.
Some people agree with these laws because they want to protect women’s sports.
Others disagree, saying these laws discriminate against transgender athletes.
The court is deciding if these laws are fair and follow the rules of the US Constitution.
They are expected to make a decision by June or early July 2026.
The court has a 6-3 conservative majority, and many of the conservative justices seemed to support the laws during the arguments.
The liberal justices mostly supported the transgender challengers.
The US Supreme Court is reviewing Idaho and West Virginia laws that ban transgender athletes from female sports.
Idaho's 2020 Fairness in Women’s Sports Act and West Virginia's 2021 Save Women’s Sports Act are being challenged for sex-based discrimination.
Lower courts ruled that these laws violate the equal protection clause and Title IX, a federal law against sex-based discrimination in education.
President Donald Trump issued an executive order to bar transgender athletes from girls’ and women’s sports, allowing federal agencies to withhold funding from non-compliant schools.
The Supreme Court, with a 6-3 conservative majority, is expected to rule on the case by June or early July 2026.
