Delhi HC: PM Cares Fund has privacy rights under RTI Act
The Delhi High Court said that the PM Cares Fund, even though it is run by the government, has the right to privacy under the Right to Information (RTI) Act.
The court was discussing a case where someone wanted to know details about the fund's income tax exemption.
The court said that just because the fund does public work or is controlled by the government, it doesn't lose its privacy rights.
The fund was set up in 2020 to help during emergencies, like the COVID-19 pandemic.
The court will hear more about this on February 10.
Some people have criticized the fund for not being transparent.
Delhi High Court remarked that PM Cares Fund has privacy rights under RTI Act even if it is a government entity.
The court was hearing an appeal seeking disclosure of information submitted by PM Cares Fund for income tax exemption.
The fund was established in March 2020 to deal with emergencies like the COVID-19 pandemic.
The court observed that the RTI Act bars disclosure of third-party information and that public or private trusts have equal privacy rights.
The next hearing is scheduled for February 10.
