Delhi Court Quashes Rape Case, Calls Failed Relationships Non-Criminal
The Delhi High Court has decided that a failed relationship cannot be called rape just because it ended badly.
The court looked at a case where a woman said she was raped, but the judge found that she and the man had been in a relationship for four years and had been in touch even after the supposed crime.
The court said that people should not use the law to settle personal problems.
They also said that there was no proof of any promise of marriage or any caste-based abuse.
So, the court decided to stop the case.
Delhi High Court quashed an FIR alleging rape and caste-based atrocity in a failed relationship case.
The court ruled that consensual relationships turning sour cannot be retrospectively branded as rape.
The parties had a long-standing consensual romantic relationship of nearly four years.
The court found no evidence of coercion, force, or caste-based abuse in the WhatsApp communications.
The court noted a five-month delay in lodging the FIR and the complainant's continued communication with the accused post-alleged incident.
